Step-by-Step Guide
Overview
Creating a prenup is a simpler process than most people think. With Noberu, the entire process takes about two weeks from registration to signing at the notary. Here is the complete guide, step by step.
Step 1: Choose a Property Regime
The first step is to decide what type of agreement suits you. The main options:
- Full separation - each asset belongs to whoever acquired it. Suitable for business owners and second marriages
- Full sharing - all assets are shared. Suitable for couples without significant assets
- Partial sharing (most common) - some assets are personal and some are shared
- Custom arrangement - a unique combination suited to your circumstances
Tip: If you are unsure, partial sharing is usually the right choice. It allows protecting specific assets while sharing in building a joint future.
Step 2: List All Assets and Debts
Before an agreement can be drafted, you need a complete picture of each party's financial situation:
Assets:
- Apartments and real estate
- Bank accounts and savings
- Pension and provident funds
- Investments (stocks, bonds, funds)
- Businesses and partnerships
- Vehicles
- Cryptocurrency
- Valuable jewelry and artwork
Debts:
- Mortgages
- Bank loans
- Third-party loans
- Credit card debts
Important: Full disclosure is a legal requirement. Hiding assets can lead to the agreement being voided.
Step 3: Draft the Agreement
Using Noberu:
- Register on the website (free)
- Complete the guided questionnaire (15-30 minutes per partner)
- Each partner fills it out separately
- The system automatically identifies disagreements
- Resolve disagreements through the discussion interface
- Pay (590 NIS) when you are ready to generate the agreement
Using a lawyer:
- Schedule an initial consultation
- Provide documents (asset list, ID cards)
- The lawyer drafts a first version
- Review and corrections
- Final draft
Step 4: Lawyer Review
Whether you used Noberu or a private lawyer, lawyer review is a critical step:
- The lawyer checks that the agreement meets legal requirements
- Verifies the agreement is fair and protects both parties
- Adds notes or corrections as needed
- Gives final approval
At Noberu, the lawyer review takes 3-5 business days. You receive a notification when the agreement is approved.
Step 5: Formal Approval (Notary/Court)
Before marriage - Notary:
- Schedule an appointment with a notary (Noberu refers you to a notary in your area)
- Bring ID cards and the printed agreement
- The notary reads the agreement and verifies understanding and free will
- Both parties sign before the notary
- The notary certifies and signs
During marriage - Court:
- File a request for approval of a prenuptial agreement
- Pay the court filing fee
- Appear before the judge
- The judge approves the agreement
Step 6: Post-Signing Compliance ("The Ten Commandments")
Signing is not the end - it is the beginning. For the agreement to stand the test of time, especially for tax purposes:
- Open separate bank accounts
- Do not commingle personal and joint funds
- Register assets in the correct owner's name
- Do not sign mutual guarantees
- Keep records of every financial transfer
- File taxes separately when relevant
