What Is a Notary for a Prenup?

In Israel, a prenup notary is the legally designated authority under the Property Relations Between Spouses Law (5773-1973) to certify a prenuptial agreement signed before marriage. No notarial certification means no legal validity — regardless of how many lawyers reviewed the document, how many witnesses were present, or how carefully the clauses were drafted. The notary is the sole gateway to enforceability before the wedding.

What the Notary Actually Does

This is not a rubber-stamp process. The notary's role for a prenup is substantive:

• Identity verification — confirms both signatories are who they say they are
• Free will interview — personally interviews both parties (separately or together) to rule out coercion, undue pressure, or duress
• Comprehension check — verifies that each party genuinely understands the agreement's contents and implications
• Official seal — once satisfied, applies the notarial signature and office stamp, conferring binding legal force

This differs significantly from routine notary work (apostilles, bank documents). For a prenup, the notary must conduct a live, in-person interview with both parties — remote or proxy signing is not permitted.

The Fixed Fee

Under Notaries Notice 5786-2025, §11(a), the fee is fixed by law:

• ₪526 for certifying the prenup agreement
• ₪74 per additional certified copy

This fee is paid directly to the notary and is separate from the cost of drafting the agreement itself.

Married Couples: Court, Not Notary

Couples who are already married cannot use a notary for a postnuptial agreement. Israeli law requires approval from a family court or rabbinical court instead. The notary route applies exclusively to pre-marriage agreements.
