The Core Issue: Israeli Default Property Rules
Without a prenup, Israeli law's default regime applies to your marriage:
The Property Relations Law (1973) — for couples married after June 1974 — establishes "asset equalization": everything accumulated during the marriage (in Israel and abroad) is split 50/50 at divorce or death.
This means:
- A 401k you had before aliyah but continued contributing to during marriage may be subject to equalization for the portion accumulated during marriage
- A UK property you owned before marriage but lived in together might be claimed as partially shared
- US brokerage account growth during the marriage could be equalized
A prenuptial agreement lets you define clearly what is yours, what is shared, and what law governs each asset.
What Olim Typically Want to Protect
Pre-Aliyah Retirement Accounts (401k, IRA, UK Pension)
These accounts were built before you came to Israel. An Israeli prenup can specify that contributions made before marriage — and the growth attributed to those contributions — are separate property.
Foreign Real Estate
Property owned in another country before marriage. An Israeli prenup can declare it separate property, but enforceability in the foreign country depends on local law.
US Stock Portfolios / UK ISAs
Similar to retirement accounts — specify the opening balance at the date of marriage as separate, and define how gains are treated.
RSUs and Stock Options from a Foreign Employer

If you own a business incorporated abroad, the prenup can specify that it — and its growth — remains your separate property.
Does Your Foreign Prenup Work in Israel?
A prenup signed in the US, UK, or elsewhere is not automatically enforceable in Israel. Israeli courts apply conflict-of-laws rules and may refuse clauses that violate Israeli mandatory law — such as waiving child support rights — regardless of the foreign document. If the couple relocated to Israel, courts often apply Israeli law as the "habitual residence" jurisdiction, and rabbinical courts may not recognize foreign prenups at all, making a separate Israeli prenup the only certain protection.

How the Israeli Prenup Approval Process Works for Olim
The process is identical for Olim and native Israelis:
Step 1: Complete the Questionnaire
